My last email to Marie before filing my lawsuit.

That yard was an unmitigated disaster from day one, your own statements confirm that. You are literally blaming my dogs for killing weeds. "I realize that there was no lush grass in the back but there was more of it and mostly weeds but it’s what held the dirt in place." Those are YOUR words. If you truly believe a judge is going to say that my dogs being responsible for killing mostly weeds in a yard you agreed to have them in with a $300 deposit is the cause of erosion after 2 hurricanes.... That’s a bet I’ll take. The neighbors and I joked when we first met a month after moving in about the LEANING of the fence because all the dirt that was washing down the hill. You and I discussed the condition of the yard. How it was always going to be a problem until it was properly landscaped. That yard has NEVER been maintained since the home was built and I am sure when we subpoena the last several tenants, they will verify the yard was a sand box for all practical purposes. I guarantee the home owner will be unable to provide any landscaping receipts showing anything ever invested in the yard. If there was a requirement that I maintain a certain level of weeds in the yard why was that not specified in the lease, everything else certainly was. The lease is pretty meticulous. It even mentions wiping water from floors after exiting the shower. The lease is overly thorough and yet not a mention of "weeds". I will not be held responsible for hurricane damage. It is widely known and documented that even well landscaped yards on slopes suffered greatly during the hurricanes, yet my weed filled beach on a slope is a different story? The yard nearest the home never had grass or weeds, that is 100% hurricane damage from rain runoff from the roof. Your whole premise is that my dogs killed the weeds. Maybe we should have agreed my dogs should tip toe around all the weeds? What you have is a homeowners claim for erosion, not a right to keep my money To refute your assumption that I did not level the yard, I did pay a guy $140.00 to rake the sand and clean up front and back. You have purposely avoided contacting me on dates and times we agree on. This has been ongoing since 6/24 when you first started avoiding me. I have documented pictures where you actually did damage to the blinds upstairs and actually admitted it. You ask me to trust you and invest more of my time for you to return my deposit yet it appears you are simply stretching this out looking for ways to keep the deposit. It leads me to believe there may be other financial issues involved. You have proven to not be reliable or trustworthy. Investing my time and money into your empty and hollow promises will not be happening. My only offer is this. Ill offer the $300.00 pet deposit plus an additional $200.00. That is $500.00 I will expect $3200.00 in my account on the 15th as law requires. Otherwise, we will go to court and due to the absurdity of your case being weeds based there will be attorney fees. My attorney is ready to file a lawsuit and honestly is chomping at the bit, but that’s what attorneys do. This entire email chain will be posted to social media and review sites that rate and review real estate agents and real-estate companies. The ball is in your court.
